TERMS OF USE AGREEMENT BETWEEN USER AND GRACEWELL
GraceWell is a healthcare sharing program and a program of Impact Health Sharing, Inc. (“Impact Health Sharing”).
For purposes of these Terms, the term “GraceWell,” “we,” “us,” or “our” refers to GraceWell and its associated legal entity, Impact Health Sharing.
The term “you” or “user” refers to any individual accessing or using the GraceWell website (the “Site”).
The Site is offered to you conditioned upon your acceptance of these terms, conditions, and notices without modification. By using the Site, you agree to these Terms & Conditions.
MODIFICATION OF THESE TERMS
GraceWell reserves the right to change these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance of those changes.
LINKS TO THIRD-PARTY SITES
The Site may contain links to third-party websites (“Linked Sites”).
GraceWell does not control and is not responsible for the content, updates, or privacy practices of Linked Sites. Inclusion of a link does not imply endorsement.
NO UNLAWFUL OR PROHIBITED USE
You agree not to use the Site for any unlawful purpose or any purpose prohibited by these Terms.
You may not:
- Damage, disable, or impair the Site
- Interfere with another user’s experience
- Attempt to access materials not intentionally made available
USE OF COMMUNICATION SERVICES
The Site may include message boards, chat tools, forums, or other communication features (“Communication Services”).
You agree to use these services only for lawful and appropriate purposes.
You agree not to:
- Harass, threaten, or violate the rights of others
- Post unlawful, obscene, defamatory, or infringing material
- Upload malicious code or viruses
- Harvest personal information without consent
- Violate applicable laws
GraceWell reserves the right to remove content and restrict access at its discretion.
SMS MESSAGING TERMS
By providing your mobile phone number and opting in to receive text messages from GraceWell, you consent to receive SMS communications related to your inquiry, membership, account updates, or requested services.
Message frequency may vary. Message and data rates may apply. Consent to receive text messages is not a condition of purchase or membership.
You may opt out at any time by replying STOP. For assistance, reply HELP.
Mobile information and opt-in consent will not be shared with third parties for marketing or promotional purposes. Carriers are not liable for delayed or undelivered messages.
MATERIALS YOU SUBMIT
If you provide feedback, suggestions, or other materials (“Submissions”), you grant GraceWell the right to use, copy, distribute, reproduce, edit, and publish such materials in connection with its services.
You represent that you have the necessary rights to provide such Submissions.
No compensation will be paid for submitted materials.
LIABILITY DISCLAIMER
THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED ON OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS.
CHANGES MAY BE MADE AT ANY TIME.
INFORMATION PROVIDED THROUGH THE SITE SHOULD NOT BE RELIED UPON FOR MEDICAL, LEGAL, OR FINANCIAL DECISIONS. YOU SHOULD CONSULT AN APPROPRIATE PROFESSIONAL FOR SPECIFIC ADVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL CONTENT IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND.
GRACEWELL DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRACEWELL SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM USE OF THE SITE.
IF YOU ARE DISSATISFIED WITH THE SITE OR THESE TERMS, YOUR SOLE REMEDY IS TO DISCONTINUE USE.
TERMINATION
GraceWell reserves the right to terminate access to the Site at any time without notice.
GOVERNING LAW
These Terms are governed by the laws of the State of Florida.
You consent to exclusive jurisdiction and venue in Broward County, Florida for disputes arising from use of the Site.
If any provision is deemed unenforceable, the remainder shall remain in effect.
These Terms constitute the entire agreement between you and GraceWell regarding use of the Site.
